Sam, long time for a reply. On this forum could you find for me where it says that pollen or seed can be used. It maybe in "Terms of Use". Has anyone said that pollen or seed CAN NOT be used? As you "seem" to know law or laws you would understand the litigation that can come from the naming of companies without "proof". If Magic Gardens got this and started proceedings against a forum, under forum rules the administrator has to comply with any Legal obligations placed upon them as they have accepted the "TERMS OF USE" as set down by the forum providors. So if you want to bag Magic Gardens why vent here, why not go straight to them. Apart from this post and 2 others as a member you seem not wanting to contribute on the subjects which members started and others have replied to. Any posts (questions, rose types, pests and diseases) or posts of your roses I believe you would get replies. You said and I have cut and pasted it here, "So I'm happy to watch the members here sprout miss information and miss inform members regaring the Quality of any Rose Suppliers by cencoring any negative coments." Since I signed up to Rose Exchange and agreed with a critical post about Magic Garden I have had a couple of PM's 1st From roseman To Sunny Sam, 26th November 2009, 9:12 pm Hi Sam, I hope I may call you by this, My name is David, I am am member of both forums and co-admin this one and have just read your post on RE, we here do not usually name and shame as it could become a legal issue. If you need to do it between members which you will become acquainted with through sharing your knowledge and theirs. If you go back to the archives and read the length that we have gone to with the issue of "PBRd" roses you will see. Simon went through a PBR lawyer and I went straight to Mr Austin in England, as it was his roses that where in the mix of what you can and not do. Brownthumbs comes from WA and has the most to loose from Magic Garden Roses sending plants without the correct AQIS acreditations. As Magic Garden Roses is situated amoungst vineyards. They could devistate the Wine industry in WA. Roseman talks about the legal issuse of PBR and the legal research Simon has done on PBR. Yet on Rose Talk the PBR info states you can use pollen or seeds from PBR plants THIS IS WRONG! As the PBR holder on a number of plants (not roses) I have a DNA marker put in my plants and have stopped 2 major companies from distributing seedling of my plant with large out of court setailments for damages thank you very much.
